FNS is proposing to amend its regulations to make access and parity improvements within several food distribution programs, including the Commodity Supplemental Food Program, the Food Distribution Program on Indian Reservations, The Emergency Food Assistance Program, and USDA Foods disaster response. This memorandum implements requirements under the Agriculture Improvement Act of 2018 and provides guidance to TEFAP state agencies on best practices to minimize food waste of privately donated foods provided to TEFAP state agencies and eligible recipient agencies.
Section 4104 of the Farm Bill directs USDA to issue guidance to promote awareness of donations of apparently wholesome food by qualified direct donors protected under section 22(c) of the Child Nutrition Act of 1966. This guidance only applies to privately donated foods provided to TEFAP state agencies and eligible recipient agencies and is not applicable to USDA Foods provided through TEFAP.
The Agriculture Improvement Act of 2018 changes TEFAP state plan requirements and the TEFAP food funding formula.
This rule proposes to revise and clarify requirements for the processing of donated foods in order to: Incorporate successful processing options tested in demonstration projects, ensure accountability for donated foods provided for processing, and increase program efficiency.
The purpose of this policy memorandum is to clarify the options available to state distributing agencies or recipient agencies in assigning value to USDA donated foods for audit purposes.
This memorandum is being released on the direction of the Consolidated and Further Continuing Appropriations Act of 2012 (PL 112-255), Conference Report 112-284. This policy memo clarifies the TEFAP regulations at 7 CFR Part 251.5(b).
