FNS is notifying WIC state agencies that the WIC Policy Memorandum #2011-6, Authority to Exceed the Maximum Amount of Liquid Infant Formula, dated June 1, 2011, is cancelled.

This memo transmits the requirements for a state agency seeking to implement EBT/CVB at WIC-authorized Farmers and Farmers' Markets.

This policy memorandum transmits the 2019-2020 Income Eligibility Guidelines for the Special Supplemental Nutrition Program for Women, Infants and Children (WIC) that were published in the Federal Register on April 26, 2019.

The VENA Guidance is intended to guide WIC state agencies in developing policies and procedures related to all aspects of nutrition assessment.

This policy memorandum supplements the guidance provided to state agencies on Jan. 4, 2006, regarding the significance of the Temporary Restraining Order issued on Dec. 29, 2005, by the U.S. District Court for the District of Columbia, for the implementation of the WIC Vendor Cost Containment Interim Rule, published in the Federal Register on Nov. 29, 2005.

The purpose of this memorandum is to ensure that all stakeholders are aware of the federal regulatory scheme related to bidding on single milk- and soy-based infant formula rebate contracts.

With the recent passage of the Families First Coronavirus Response Act to assist with the novel coronavirus public health emergency,  WIC received an increase in funding for the program as well as increased ability to provide states with the flexibilities they need to support mothers, infants and children that rely on WIC.

USDA’s Food and Nutrition Service recommends WIC clinics dispose of unused, returned WIC infant formula in accordance with state and local health and safety laws. FNS does not recommend donating unused, returned WIC infant formula to entities such as food banks or food pantries.

The Families First Coronavirus Response Act provides USDA statutory and regulatory waiver authorities necessary in a public health emergency such as COVID-19 to encourage social distancing and reduce visits to WIC clinics. To date, FNS has approved requests from all WIC state agencies to waive select statutory and regulatory requirements through May 31, 2020. USDA FNS is extending waiver approvals through June 30, 2020 for all WIC state agencies that choose to continue operations under their approved waivers.

This policy memorandum contains guidance to WIC state agencies regarding the Coronavirus Aid, Relief and Economic Security Act that provides rebates to many low- and middle-income households, as well as additional unemployment benefits. FNS has received a number of questions regarding how WIC state agencies should consider payments to individuals authorized under the Act when conducting a WIC income determination.
