The Food and Nutrition Service (FNS) is issuing this memorandum to notify WIC state agencies that the WIC Policy Memorandum #2011-6, Authority to Exceed the Maximum Amount of Liquid Infant Formula, dated June 1, 2011, is cancelled.
Appropriations law no longer provides the authority to permit issuance of liquid concentrate and ready-to-feed infant formula above the maximum monthly amount allowed. Previously, Section 733 of the Agriculture, Rural Development, Food and Drug Administration, and Related Agencies Appropriations Act, 2010 (PL 111-80), and subsequent annual appropriations laws permitted this practice if the full nutrition benefit amount could not be provided without exceeding the maximum monthly amount.
Policy Memorandum #2011-6, applicable specifically to Nestle Gerber® Good Start brand liquid concentrate and ready-to-feed infant formula products, is no longer necessary due to subsequent regulatory revision. Following issuance of the 2011 policy memorandum, FNS revised WIC regulations at 7 CFR 246.10 to accommodate issuance of infant formula products readily available to the program in the marketplace, including the Nestle Gerber® Good Start brand products.
