This memorandum is to inform you that all foods of minimal nutritional value exemptions will end on June 30, 2014. Therefore, the attached list, Exemptions Under the Competitive Foods Regulation will become obsolete on July 1, 2014. Beginning July, 1, 2014, the interim final rule for Smart Snacks in School will go into effect for school year 2014-15. Therefore, any competitive foods and beverages must meet the nutrition standards specified in the interim final rule.

The purpose of this memorandum is to remind state agencies, school food authorities, schools, and sponsoring organizations operating in the National School Lunch Program, the School Breakfast Program, the Child and Adult Care Food Program, and the Summer Food Service Program about data sharing requirements and opportunities.

The purpose of this memorandum is to clarify the status of grain-only items as entrées under the Interim Final Rule titled “National School Lunch Program and School Breakfast Program: Nutrition Standards for All Foods Sold in School as Required by the Healthy, Hunger-Free Kids Act of 2010,” also known as the Smart Snacks in School rule.

Section 4 of the Richard B. Russell National School Lunch Act provides general cash for food assistance payments to states to assist schools in purchasing food. The NSLA provides two different section 4 payment levels for lunches served under the NSLP.

The purpose of this memorandum is to inform processors of minimum inventory protection requirements effective beginning in School Year 2014-2015.

This memorandum clarifies how school food authorities may use funds provided under Sections 4 and 11 or 19 of the National School Lunch Act to purchase fresh fruits and vegetables from DoD Fresh Fruit and Vegetable Program vendors.

The attached memorandum of questions and answers, issued jointly by the Food and Nutrition Service headquarters, food distribution and child nutrition divisions, clarifies the use of SAE funds, both as initially allocated and when reallocated, for administrative and other expenses incurred in the food distribution program.

The purpose of this memorandum is to advise you of a new and revised requirement for all Receiving Organizations (i.e., organizations that receive shipments of Department of Agriculture (USDA) Foods, including Distributing Agencies, Indian Tribal Organizations (ITO), recipient agencies, processors, and warehouses). This memorandum replaces the previous FD-062 dated April 25, 2011 , and adjusts the maximum timeframe for entering shipment receipts in the Web-Based Supply Chain Management System.

FNS recently released the new Administrative Review Guidance Manual, which includes four options that state agencies may use to assess compliance with Dietary Specifications – calories, saturated fat, and sodium – requirements. 

This memorandum and its attachment supersede SP-37-2011, Child Nutrition 2010: Enhancing the School Food Safety Program. Attached are questions and answers regarding the school food safety requirements for schools participating in FNS child nutrition programs.
