Attached are revised Questions and Answers related to the final rule entitled, Certification of Compliance with Meal Requirements for the National School Lunch Program under the Healthy, Hunger-Free Kids Act of 2010.

FNS recently released the new Administrative Review Guidance Manual, which includes four options that state agencies may use to assess compliance with Dietary Specifications – calories, saturated fat, and sodium – requirements. 

This memorandum provides information regarding the state agencies’ quarterly reporting requirements associated with identifying the number of school food authorities certified to receive the performance-based reimbursement for each lunch served in compliance with the new meal pattern requirements for the National School Lunch and School Breakfast Programs.

Attached for your use is a prototype Performance Work Statement, Evaluation Criteria and Performance Metrics document to assist state agencies that wish to procure a contract(s) to perform the performance-based reimbursement certification and other training activities to support the Certification of Compliance With Meal Requirements for the National School Lunch Program Under the Healthy, Hunger-Free Kids Act of 2010 Interim Rule and the new meal pattern final rule.

Presentation. Certification of Compliance with New Meal Pattern Requirements

This rule amends the regulations affecting the determination of children's eligibility for free meals under the National School Lunch Program and the School Breakfast Program by direct certification and categorical eligibility. Conforming changes and miscellaneous technical changes are also made, as appropriate, for the Special Milk Program for Children, the Child and Adult Care Food Program and the Summer Food Service Program.

The Child Nutrition and WIC Reauthorization Act authorizes FNS to award $9,000,000 in FY 2006 to be used to assist states in implementing mandatory direct certification and other provisions related to certification and verification of students’ eligibility to receive free and reduced price meal benefits in the school nutrition programs.
