Program regulations require administering agencies (state educational, alternate or distributing agencies, or Food and Nutrition regional offices) to enter into written agreements with school food authorities or sponsoring organizations of child care facilities or summer sites which desire to participate in one or more of the Department's child nutrition programs.

This Instruction sets forth the policy that partial implementation of the National School Lunch and Commodity School Programs is not allowed, but that partial implementation of the School Breakfast Program may be allowed under certain circumstances.

The purpose of this instruction is to clarify our position on tax-exempt status for Summer Food Service Program sires.

This instruction will clarify (1) program eligibility requirements for outside-school-hours care centers (OSHCCs) and (2) the prohibition against program coverage of extracurricular activities in schools operating as OSHCCs.

This Instruction implements the agency's policy on administration of multi-state sponsoring organizations in the Child Care Food Program. 

The rapid growth of multi-state sponsoring organizations over 'the past several years has presented administering agencies (both state agencies and Food and Nutrition Service regional offices) with new problems in reviewing and approving administrative budgets.

 

A state agency may make payment for meals served in accordance with provisions of the program in the calendar month preceding the calendar month in which the agreement is executed. This provision applies only to center programs and to home programs which are renewing their agreements. The agreements of new home sponsoring organizations may not be backdated.

This Instruction clarifies the Department's policy regarding the use of school feeding facilities as community resources for such activities as feeding programs for the elderly, and provides information on the nutrition program for the elderly authorized by PL 92-258.

This Instruction prescribes the amounts and use of nonfat dry milk, whole dry milk, and canned evaporated milk which are equivalent to one-half pint of fluid whole milk. These equivalents are to be used in schools approved for the service of lunches without milk.

This Instruction provides information for state agencies with respect to the matching requirements of Section 210.6 of the National School Lunch Program Regulations as they pertain to state revenues.
