This memo provides guidance on the use of SNAP E&T funds to pay for services for individuals who are attending high school. In most cases, it is likely neither legal nor appropriate to use E&T funds to pay for services for individuals are attending high school. In some instances, however, it is allowed and encouraged to use E&T funds for individuals who are of high school age, such as for individuals aged 16-17 who are subject to SNAP work requirements.

Resource | Policy Memos | FNS-GD-2019-0091 Questions and Answers: Final Rulemaking Requirements for ABAWDs

On Dec. 5, 2019, the  FNS final rule, Supplemental Nutrition Assistance Program: Requirements for Able-Bodied Adults Without Dependents, will publish in the Federal Register. The rule revises the conditions under which FNS would waive, when requested by states, the able-bodied adult without dependents (ABAWD) time limit in areas that have an unemployment rate of over 10 percent or a lack of sufficient jobs. In addition, the rule limits the carryover of unused ABAWD discretionary exemptions.

In accordance with the Paperwork Reduction Act of 1995, this notice invites the general public and other public agencies to comment on this proposed information collection. This collection is an extension, without change, of a currently approved collection for annual outcome data for the Supplemental Nutrition Assistance Program (SNAP) Employment and Training (E&T) programs, as mandated by Section 16(h)(5) of the Food and Nutrition Act (FNA) and as amended by section 4022 of the Agricultural Act of 2014.

This proposed rule seeks to amend the regulatory standards by which USDA evaluates state Supplemental Nutrition Assistance Program agency requests to waive the time limit and to end the unlimited carryover of able-bodied adults without dependents (ABAWD) percentage exemptions.  FNS seeks to reopen the comment period on April 8, 2019, for a period of 3 days ending April 10, 2019.

The guidance provided by these memoranda is outdated and has been superseded by the Final Rule: Revisions and Clarifications in Requirements for the Processing of Donated Foods, which was published on May 1, 2018.
