This proposed rule would require all local educational agencies participating in the National School Lunch Program and/or the School Breakfast Program to meet expanded local school wellness policy requirements consistent with the new requirements set forth in section 204 of the Healthy, Hunger-Free Kids Act of 2010.

This memorandum and its attachment supersede SP-37-2011, Child Nutrition 2010: Enhancing the School Food Safety Program. Attached are questions and answers regarding the school food safety requirements for schools participating in FNS child nutrition programs.

Following the Jan. 26, 2012, issuance of the final rule titled Nutrition Standards in the National School Lunch and School Breakfast Programs, several questions have been raised regarding its effect on current contracts between school food authorities and food service management companies.
This memorandum satisfies GAO’s recommendations for the Food and Nutrition Service to issue more specific guidance to states and school districts regarding the applicability of the food safety inspections requirement in schools that do not prepare food, such as those that only serve pre-packaged meals or meals delivered from a central preparation location (referred to in this memorandum as service-only sites).
This memorandum provides information on the new requirements for local wellness policies so that local educational agencies can begin reviewing their policies for the coming school year 2011-12, and begin moving forward on implementing the new requirements.
