Follow up to letter dated May 24, 2022 and recent listening sessions with state health commissioners and WIC state agencies.

This memorandum sets forth applicable parameters for implementation of the infant formula cost containment contracts and waiver authority legislative provisions, effective immediately. The provisions set forth in this policy memorandum will also be incorporated into the federal WIC regulations through future rulemaking.

This policy memorandum transmits the 2022-2023 Income Eligibility Guidelines (IEGs) for WIC that were published in the Federal Register on March 29, 2022 at 87 FR 17977.

This study informs FNS about the reasons behind underredemption of the cash-value benefit issued to participants in WIC. 

USDA announces adjusted income eligibility guidelines to be used by state agencies in determining the income eligibility of persons applying to participate in WIC. These income eligibility guidelines are to be used in conjunction with the WIC regulations.

This memorandum provides information on the exclusion as income of rebates under the American Rescue Plan Act of 2021 in FDPIR, TEFAP, and CSFP.

On Dec. 27, 2020, the President signed into law the Consolidated Appropriations Act 2021. This Act excludes federal pandemic unemployment compensation payments authorized under the Coronavirus Aid, Relief and Economic Security Act from consideration as income for the purposes of determining FDPIR eligibility. 

FNS is codifying a revised statutory requirement included in the Agriculture Improvement Act of 2018. The 2018 Farm Bill at section 4003 requires FDPIR administrative funds to remain available for obligation at the Indian Tribal Organization (ITO) and state agency level for a period of two federal fiscal years. This provision was self-executing and went into effect upon enactment of the 2018 Farm Bill in federal fiscal year 2019. 

FNS is cancelling Policy Memoranda FD-010, FD-027, FD-028, FD-029, FD-032, FD-053, FD-055, FD-071, FD-073, FD-074, FD-083, FD-086, FD-087, FD-090, FD-105, and FD-115. The guidance provided by these memoranda are either outdated, obsolete, or otherwise captured in more current memoranda.

This policy memorandum transmits the 2019-2020 Income Eligibility Guidelines for the Special Supplemental Nutrition Program for Women, Infants and Children (WIC) that were published in the Federal Register on April 26, 2019.
