This memorandum consolidates and supersedes previous LEP guidance and incorporates previously released USDA and FNS guidance. FNS is issuing this guidance in a Q&A format to provide responses to questions that FNS has received regarding communications with LEP individuals.

FNS administers the SFSP at the national and regional levels. Within each state, the program is administered by the state department of education or an alternate state-designated agency. Locally, public or private non-profit organizations that want to “sponsor” the program apply and are approved by the state agency to operate a site.

This memorandum supersedes SP06, SFSP06-2016: Promoting Nutrition in Summer Meals, Nov. 12, 2015.

This memorandum provides guidance to state agencies administering the Summer Food Service Program that are seeking to approve non-profit organizations such as higher education institutions and hospitals that are under contract with a food service management company to provide food service operations.

The Department of Agriculture has submitted the following information collection requirement(s) to OMB for review and clearance under the Paperwork Reduction Act of 1995.

This rule proposes to codify several provisions of the Healthy, Hunger-Free Kids Act of 2010 affecting the integrity of the child nutrition programs, including the National School Lunch Program, the Special Milk Program for Children, the School Breakfast Program, the Summer Food Service Program, the Child and Adult Care Food Program and state administrative expense funds.

On Dec. 1, 2014, the U.S. Department of Health and Human Services, Food and Drug Administration published the final rule, Food Labeling; Calorie Labeling of Articles of Food in Vending Machines, in the Federal Register.

In accordance with the Paperwork Reduction Act of 1995, this notice invites the general public and other public agencies to comment on this information collection. This collection is a revision of a currently approved collection for state administrative expense funds expended in the operation of the child nutrition programs (7 CFR parts 210, 215, 220, 226 and 250) administered under the Child Nutrition Act of 1966.
