FNS published a final rule on program integrity to ensure that child nutrition programs are properly operated and managed to protect federal funds and taxpayer dollars.
School meals are required to meet specific nutrition standards to operate the school meals programs. The standards align school meals with the latest nutrition science and the real world circumstances of America’s schools.
This rule proposes to codify several provisions of the Healthy, Hunger-Free Kids Act of 2010 affecting the integrity of the child nutrition programs, including the National School Lunch Program, the Special Milk Program for Children, the School Breakfast Program, the Summer Food Service Program, the Child and Adult Care Food Program and state administrative expense funds.

Attached for your use is a prototype Performance Work Statement, Evaluation Criteria and Performance Metrics document to assist state agencies that wish to procure a contract(s) to perform the performance-based reimbursement certification and other training activities to support the Certification of Compliance With Meal Requirements for the National School Lunch Program Under the Healthy, Hunger-Free Kids Act of 2010 Interim Rule and the new meal pattern final rule.
This memorandum clarifies FNS policy regarding the calorie and nutrient requirements for meals planned using alternate menu planning approaches.
It has come to our attention that there may be some confusion concerning fluid milk, and how it is offered in reimbursable lunches. Under all menu planning approaches, fluid milk is a separate food component/menu item.
This final rule makes a number of technical changes to the regulations governing the National School Lunch Program, the Special Milk Program for Children, the School Breakfast Program, state administrative expense funds, determining eligibility for free and reduced price meals and free milk in schools.
The National School Lunch Act requires that schools that are participating in the National School Lunch or School Breakfast Programs claim reimbursements only for lunches or breakfasts which meet the nutrition standards of the National School Lunch Act, including compliance with the Dietary Guidelines for Americans.
