These materials can be used as tools to educate students and school nutrition professionals on Offer vs Serve.

During the public health emergency due to COVID-19, FNS waives, for all states, requirements that limit the use of Offer versus Serve to school food authorities and require sponsors to apply OVS under the rules followed for the National School Lunch Program.

FNS is establishing a nationwide waiver to support access to nutritious meals while minimizing potential exposure to the novel coronavirus for school year 2020-21.

School meals are required to meet specific nutrition standards to operate the school meals programs. The standards align school meals with the latest nutrition science and the real world circumstances of America’s schools. 

Offer versus Serve is a provision in the NSLP and School Breakfast Program that allows students to decline some of the food offered. The goals of OVS are to reduce food waste in the school meals programs while permitting students to decline foods they do not intend to eat. 

This instruction is intended to clarify allowable variations to child nutrition program food components in order to meet religious needs among Jewish schools, institutions and sponsors. 

Letter of Verification Results and Adverse Action

This guidance replaces the 2004 edition of the Offer versus Serve in the School Nutrition Programs Resource Guide. In addition, please note that this guidance will be revised for School Year 2014-15 and beyond to reflect newly implemented meal pattern requirements as they are phased in.

Attached for your use is a prototype Performance Work Statement, Evaluation Criteria and Performance Metrics document to assist state agencies that wish to procure a contract(s) to perform the performance-based reimbursement certification and other training activities to support the Certification of Compliance With Meal Requirements for the National School Lunch Program Under the Healthy, Hunger-Free Kids Act of 2010 Interim Rule and the new meal pattern final rule.
