This guidance applies to state agencies and local educational agencies administering the National School Lunch Program and the School Breakfast Program. This guidance provides information on the final rule, Child Nutrition Programs: Community Eligibility Provision – Increasing Options for School.

USDA FNS is proposing to add a new system of records, entitled USDA/FNS–13, Mercury, which is a Consumer Off the Shelf workflow system designed to automate the correspondence tracking and management process within FNS.

In order to update and streamline policy guidance for CSFP and TEFAP, FNS is cancelling Policy Memoranda FD-138 and FD-141.

FNS is communicating the following guidance to remind WIC state agencies and WIC authorized vendors of our ongoing commitment to ensure the safety of infant formula purchased in the WIC program, and to prevent stolen infant formula from being purchased with WIC benefits.

The purpose of this memo is to allocate funding for Farm to Food Bank Projects in FY 2024.

FNS is proposing to amend its regulations to make access and parity improvements within several food distribution programs, including the Commodity Supplemental Food Program, the Food Distribution Program on Indian Reservations, The Emergency Food Assistance Program, and USDA Foods disaster response. The proposed provisions use plain language to make them easier to read and understand.

USDA has legislative authority to grant waivers to WIC and FMNP state agencies. The American Rescue Plan Act of 2021 grants temporary waiver authority to WIC and WIC FMNP for the purpose of outreach, modernization, and innovation and The Access to Baby Formula Act of 2022 grants permanent waiver authority to WIC during certain emergencies and supply chain disruptions. This information collection request covers activities associated with the waiver request process.

USDA intends to use all available program flexibilities and contingencies to serve our program participants across our 15 nutrition programs. We have already begun to issue waivers to ease program operations and protect the health of participants.

This memorandum provides initial implementation guidance for the Child Nutrition Program Integrity Final Rule. This memorandum applies to state agencies administering and school food authorities, institutions and sponsors implementing the NSLP, SBP, CACFP, and SFSP.

This action implements statutory requirements and policy improvements to strengthen administrative oversight and operational performance of the Child Nutrition Programs.
