This action proposes to amend Food Stamp Program regulations to implement several provisions of the Mickey Leland Childhood Hunger Relief Act.

This rule implements several legislative provisions from the Food, Agriculture, Conservation, and Trade Act Amendments of 1991, the Mickey Leland Childhood Hunger Relief Act of 1993, and the Food Stamp Program Improvements Act of 1994. It finalizes provisions in a proposed rule published in the Federal Register on Nov. 1, 1993.

FNS is proposing to amend Food Stamp Program regulations by increasing the disqualification penalties for individuals who are found guilty in a federal, state or local court of trading or receiving food stamp coupons (coupons) for firearms, ammunition, explosives or controlled substances.

This notice announces the annual adjustments to the national average payment rates for meals served in child care, outside-school- hours care and adult day care centers, the food service payment rates for meals served in day care homes, and the administrative reimbursement rates for sponsors of day care homes to reflect changes in the Consumer Price Index.

This final rule establishes the rules of practice governing the administrative review process for state agencies challenging food stamp quality control claims and is intended to speed the resolution of the QC claims.

This policy memorandum provides clarification regarding the classification of loggers as migrant farmworkers. Also, in anticipation of other queries about occupational groups which might be defined as migrant farmworkers, the following guidance is provided.

Recently, cultural food preferences among participants in the WIC program have received considerable attention. There has been concern expressed that some WIC participants may not take full advantage of program benefits (e.g., the food packages and nutrition education) for cultural reasons. In this Notice, the Department is soliciting public comments regarding the issues surrounding the accommodation of cultural food preferences in the WIC program.

This action excludes certain utility reimbursements made by the Department of Housing and Urban Development (HUD) and Farmers Home Administration (FmHA) from income consideration in determining Food Stamp Program eligibility and benefits.

This rule proposes revisions to funding and funds allocation procedures for the Special Supplemental Food Program for Women, Infants and Children (WIC) in order to simplify and update the funding process in anticipation of a fully funded program.

This policy memorandum is intended to facilitate the implementation of a Congressional mandate, set forth in the House Appropriations Committee's Report accompanying the Fiscal Year 1994 Agriculture, Rural Development, Food and Drug Administration, and Related Agencies Appropriations Act (PL 103- 111), enacted Oct. 21, 1993.
