This rule proposes to revise and clarify requirements with respect to the distribution, management, and use of donated foods in the National School Lunch Program and other child nutrition programs, the Nutrition Services Incentive Program, and by charitable institutions.
This final rule implements a provision of the Child Nutrition and WIC Reauthorization Act of 2004 by creating uniform regulations related to the disregard of overpayments in the National School Lunch Program, School Breakfast Program and Child and Adult Care Food Program.
It has come to our attention that there is some uncertainty regarding proper application of the monitoring requirements for sponsoring organizations set forth in the CACFP regulations. This memorandum provides guidance on that issue, and replaces CACFP Memorandum # 04-2006, issued on Jan. 20, 2006.
This memorandum addresses the extension of the original guidance, as well as several other questions that have arisen regarding implementation of the block claim requirement.
We continue to receive questions regarding procurements in the child nutrition programs, particularly in the National School Lunch and School Breakfast Programs. Attached are the most recently received questions and answers.
The purpose of this memorandum is to clarify the required frequency of physical inventories, per the recently revised program regulations at 7 CFR Part 247.
The purpose of this memorandum is to clarify that policies establishing limits on the specific and/or exclusive geographic areas in which CACFP sponsoring organizations may operate are inconsistent with program regulations and, as such, prohibited.
The purpose of this memorandum is to provide guidance on the impact of these modifications on the Child and Adult Care Food Program.
The new USDA Recipes for Schools should be available for distribution beginning June 1, 2006. States may order copies for all their School Districts and schools or they may forward the attached electronic order form to their School Districts so the Districts may order for their staff and their schools. Copies will not be mailed to individual schools.
This memorandum is to clarify the appropriate actions a processor must take when errors are discovered on monthly performance reports.
