This memo transmits updates to the maximum size of WIC civil monetary penalties to reflect inflationary adjustments for 2022, as required by the Federal Civil Penalties Inflation Adjustment Improvements Act of 2015. 

This policy memorandum transmits the Civil Monetary Penalty (CMP) inflation adjustment for 2021 for the Special Supplemental Nutrition Program for Women, Infants, and Children (WIC). The adjustment was published in the Federal Register as part of the Civil Monetary Penalty Inflation Adjustments for 2021 Final Rule published on May 10, 2021, at 86 FR 24699. 

This collection is a revision of a currently approved collection to provide FNS and WIC state agencies with an ongoing/annual data set that can be used to assess state agencies' compliance with WIC vendor management requirements and estimate state agencies' progress in eliminating fraud, waste, and abuse.

The purpose of this memorandum is to ensure that all stakeholders are aware of the federal regulatory requirements related to the disclosure of confidential WIC vendor and participant information.

This Informational memorandum signals USDA FNS’ intent to set forth efforts in support of the American Rescue Plan Act of 2021. The Act provides $390 million for FY 2021, to remain available through FY 2024, to carry out outreach, innovation, and program modernization efforts, including appropriate waivers and flexibility, to increase participation and redemption of benefits.

WIC Policy Memorandum: #2021-2: WIC Civil Monetary Penalty (CMP) Inflation Adjustment for 2020

This memorandum clarifies how school food authorities may use funds provided under Sections 4 and 11 or 19 of the National School Lunch Act to purchase fresh fruits and vegetables from DoD Fresh Fruit and Vegetable Program vendors.

FD-060, Use of Donated Foods in the NSLP and Other Child Nutrition Programs (dated June 21, 2006) is cancelled. 

In this memorandum, we present several options for consideration by the distributing agency to help ensure that service institutions receive donated foods for use in the summer meals provided in SFSP in an efficient and cost-effective manner.

Attached is the Interim Guidance on WIC Vendor Cost Containment. This interim guidance is intended to assist state agencies in implementing the Vendor Cost Containment Interim Rule published in the Federal Register on Nov. 29, 2005.
