This rulemaking serves to amend WIC program regulations by incorporating provisions of the Access to Baby Formula Act of 2022 and making related amendments.

This final rule amends the Community Eligibility Provision (CEP) regulations by lowering the minimum identified student percentage (ISP) from 40 percent to 25 percent. 

This is a new information collection for WIC and WIC Farmers' Market Nutrition Program which contains the reporting burden associated with requesting waivers authorized under the American Rescue Plan Act of 2021 and the American Baby Formula Act of 2022.

This is a new information collection for the contract of the study titled “How Have SNAP State Agencies Shifted Operations in the Aftermath of COVID–19? (SNAP COVID study)”.

This rulemaking proposes to expand access to the Community Eligibility Provision by lowering the minimum identified student percentage participation threshold from 40 percent to 25 percent, which would give states and schools greater flexibility to choose to invest non-federal funds to offer no-cost meals to all enrolled students.

This is an existing collection in use without an OMB Control Number to seek approval to establish a process for requesting a waiver from FNS to offer SNAP recipients incentives at SNAP authorized retailer locations that encourage them to purchase healthier foods.

This notice invites the general public and other public agencies to comment on this proposed information collection for activities associated with administering emergency allotments (EA) waivers issued by USDA based on a public health emergency declaration by the Secretary of Health and Human Services related to an outbreak of COVID-19.

FNS is seeking public comment on its intent to ask the Office of Management and Budget to extend approval of the information collection under OMB approval #0584-0654 from Jan. 31, 2022 until Aug. 27, 2023.

This collection is an extension, without change, of a currently approved collection for activities associated with administering emergency allotments waivers. The Families First Coronavirus Response Act of 2020, enacted March 18, 2020, includes a general provision that allows the Department to issue emergency allotments waivers based on a public health emergency declaration by the Secretary of Health and Human Services under section 319 of the Public Health Service Act related to an outbreak of COVID-19 when a State has also issued an emergency or disaster declaration.
