This memorandum includes questions and answers on flexibilities available to TEFAP state agencies on the operation of TEFAP. These flexibilities may assist state agencies that administer TEFAP in continuing to provide food to people in need during the novel COVID-19 public health emergency.

USDA is committed to providing nutrition assistance to hard-hit families across the country due to the coronavirus pandemic. In support of President Biden’s call to action on hunger, USDA announced that it is increasing the Pandemic EBT benefit by approximately 15 percent, providing more money for low-income families and millions of children missing meals due to school and child care closures.

USDA continues to work with state child nutrition agencies to offer flexibilities in response to public health needs while still promoting nutritious meals during the coronavirus (COVID-19) pandemic.

This memo clarifies processes to reflect system updates for state agencies pursuing additional verification through the Systematic Alien Verification for Entitlements program that have caused an area of SNAP regulations to become outdated and no longer applicable. This memo also explains how to request information on SNAP applicants who are claiming Cuban-Haitian Entrant designation.

USDA has issued guidance to states in implementing FFCRA of 2020 which provides for the issuance of emergency allotments based on a public health emergency declaration by the Secretary of HHS under the Public Health Service Act related to an outbreak of COVID-19 when a state has also issued an emergency or disaster declaration.
