This memo clarifies business integrity requirements and factors that FNS may and may not consider when determining a firm’s participation in SNAP.

This memorandum provides initial implementation guidance for the Child Nutrition Program Integrity Final Rule. This memorandum applies to state agencies administering and school food authorities, institutions and sponsors implementing the NSLP, SBP, CACFP, and SFSP.

This document informs the public that the FNS is withdrawing the proposed rule titled Revision of Categorical Eligibility in SNAP that published in the Federal Register on July 24, 2019.

This memorandum states visual observation and identification by Child and Adult Food Care Program institutions and facilities and Summer Food Service Program sponsors is no longer an allowable practice for program operators to use during the collection of race or ethnicity data.  USDA will update CACFP and SFSP policy guidance.

FNS has received questions about participant information sharing between WIC clinics and private health care providers. This memorandum sets forth the applicable requirements in WIC regulations that allow participant information to be shared.

In accordance with the Paperwork Reduction Act of 1995, this notice invites the general public and other public agencies to comment on this proposed information collection. This is a revision of a currently approved collection codified in Food and Nutrition Service regulations.

USDA proposes updating the regulations to refine categorical eligibility requirements based on receipt of TANF benefits. Specifically, the Department proposes: (1) to define “benefits” for categorical eligibility to mean ongoing and substantial benefits; and (2) to limit the types of non-cash TANF benefits conferring categorical eligibility to those that focus on subsidized employment, work supports and childcare. The proposed rule would also require state agencies to inform FNS of all non-cash TANF benefits that confer categorical eligibility.

FNS is issuing this memorandum on the use of Electronic Benefit Transfer transaction data as evidence of an intentional program violation.

This memorandum provides a reminder overview of options available under current program policy and regulation for connecting children and adult survivors, who have evacuated from areas subject to major disaster and emergency declarations, and may be staying in shelters, with child nutrition program benefits.

Local educational agencies participating in the National School Lunch Program and/or School Breakfast Program are required to develop a local school wellness policy that promotes the health of students and addresses the problem of childhood obesity.
