This is a letter clarifying public charge policy as it pertains to SNAP participation. The letter was sent to SNAP state commissioners in Jan. 2022.

This memorandum clarifies the use of third party payroll sources for SNAP certification policy and quality control purposes. The first two sections of this memorandum apply to certification policy and the section titled Quality Control Considerations provides details on how to treat verification from a third party payroll source for QC reviews.
Form FNS-101: Participation in Food Programs - by Race
Form FNS-667 is used by state agencies to report use of TEFAP administrative funds.
Form FNS-57 is used by consignees to report overages and shortages in a shipment and commodities damaged in transit.
This memorandum supplements our Reauthorization Implementation Memo SP 4 by providing additional information on identifying migrant children and on the procedures that school food authorities and local education agencies should use to coordinate with the Migrant Education Program in order to document the categorical eligibility of migrant children for free meals.
State agencies apply for reimbursement using Form FSA-21, submitted to the appropriate FNS regional office for approval.
The Department of Justice is publishing a proposed rule in this issue of the Federal Register which proposes to establish clear standards governing a determination that an alien is inadmissible or ineligible to adjust status, or has become deportable, on public charge grounds. Before the proposed rule becomes final, the Immigration and Naturalization Service is publishing its field guidance on public charge issues as an attachment to this notice.
