This guidance applies to state agencies and local educational agencies administering the National School Lunch Program and the School Breakfast Program. This guidance provides information on the final rule, Child Nutrition Programs: Community Eligibility Provision – Increasing Options for School.

This guidance outlines an additional $471.5 million being provided by FNS to enhance local school districts’ ability to purchase foods for school meals by offering resources needed to address supply chain challenges directly to schools and school districts.

Under this waiver, for all states, Summer Food Service Program and National School Lunch Program Seamless Summer Option closed enrolled sites during the COVID-19 public health emergency may determine site eligibility through area eligibility without collecting income eligibility applications.

FNS is establishing a nationwide waiver to extend area eligibility waivers through Aug. 31, 2020 to continue supporting access to nutritious meals while minimizing potential exposure to the novel coronavirus (COVID-19).

This memorandum addresses inquiries regarding flexibility in determining the effective date of eligibility for students who are directly certified to receive free meals or free milk in the National School Lunch Program, the School Breakfast Program, and the Special Milk Program.
