This rulemaking finalizes long-term school nutrition requirements based on the goals of the Dietary Guidelines for Americans, 2020-2025, robust stakeholder input, and lessons learned from prior rulemakings.

This final rule amends the Community Eligibility Provision (CEP) regulations by lowering the minimum identified student percentage (ISP) from 40 percent to 25 percent. 

USDA intends to use all available program flexibilities and contingencies to serve our program participants across our 15 nutrition programs. We have already begun to issue waivers to ease program operations and protect the health of participants.

This rulemaking amends the SFSP regulations to strengthen program integrity by clarifying, simplifying, and streamlining program administration to facilitate compliance with program requirements. 

FNS  is waiving the requirement that the state agency annually review a number of sponsors whose program reimbursements, in the aggregate, account for at least one-half of the total program reimbursements in the state in the previous year. 

This waiver extends the Nationwide Waiver of First Week Site Visits in the Summer Food Service Program – EXTENSION 2 – granted on Oct. 9, 2020, that expires on June 30, 2021– through Sept. 30, 2021. This waiver extension applies to the Summer Food Service Program.

This waiver extends the Nationwide Waiver to Allow Non-Congregate Feeding in the Summer Food Service Program and National School Lunch Program Seamless Summer Option granted on Oct. 9, 2020, that expires on June 30, 2021—through Sept. 30, 2021.

This waiver extends the Nationwide Waiver to Allow Offer Versus Serve Flexibilities in the Summer Food Service Program – EXTENSION 2 - granted on Oct. 9, 2020, that expires on June 30, 2021– through Sept. 30, 2021.

This waiver extends the Nationwide Waiver of Meal Service Time Restrictions in the Summer Food Service Program and the National School Lunch Program Seamless Summer Option - EXTENSION 2– granted on Oct. 9, 2020, that expires on June 30, 2021 – through Sept. 30, 2021.

FNS is extending a waiver of the National School Lunch Program and School Breakfast Program meal pattern requirements to support access to nutritious meals while minimizing potential exposure to the novel coronavirus (COVID–19) this summer.
