During the public health emergency due to COVID-19, FNS waives, for all states, requirements that limit the use of Offer versus Serve to school food authorities and require sponsors to apply OVS under the rules followed for the National School Lunch Program.

FNS is establishing a nationwide waiver to support access to nutritious meals while minimizing potential exposure to the novel coronavirus for school year 2020-21.

The fiscal year 2018 Direct Certification Improvement Grant Request for Applications are available to state agencies that administer the National School Lunch and the School Breakfast programs to fund the costs of improving your direct certification rates with SNAP, and other needs-based assistance programs.

In accordance with the Paperwork Reduction Act of 1995, this notice invites the general public and other public agencies to comment on this proposed information collection. This is a new collection for the Evaluation of the Direct Certification with Medicaid for Free and Reduced-Price Meals Demonstrations.

This collection is a reinstatement, without change, of a previously approved collection for which approval has expired for the state agency Direct Certification Rate Data Element Report.

On Dec. 1, 2014, the U.S. Department of Health and Human Services, Food and Drug Administration published the final rule, Food Labeling; Calorie Labeling of Articles of Food in Vending Machines, in the Federal Register.

Offer versus Serve is a provision in the NSLP and School Breakfast Program that allows students to decline some of the food offered. The goals of OVS are to reduce food waste in the school meals programs while permitting students to decline foods they do not intend to eat. 

The U.S. Department of Health and Human Services, Food and Drug Administration (FDA) published the final rule, Nutrition Labeling of Standard Menu Items in Restaurants and Similar Retail Food Establishments in the Federal Register (79 FR 71155) on Dec. 1, 2014.

The purpose of this memorandum is to provide state agencies and child nutrition program operators, including the National School Lunch Program, School Breakfast Program, Child and Adult Care Food Program, and Summer Food Service Program, with additional information and clarification on the administrative review process regarding the child nutrition label, watermarked CN label, and manufacturer’s product formulation statement.
