This notice announces the surplus and purchased foods that USDA expects to make available for donation to states for use in providing nutrition assistance to the needy under TEFAP in FY 2010.
This final rule amends regulations by making state plans permanent, and by explicitly designating the processing of donated wild game as an allowable use of TEFAP administrative funds.
It has come to our attention that there is uncertainty in determining when an income eligibility form has expired and when it needs to be excluded from claiming percentage calculations for CACFP.
This memorandum clarifies FNS regulations and policies regarding the allowability of requiring payment and soliciting contributions (i.e., "payments" or "pay") in exchange for foods from FNS program participants.

Per CSFP regulations, participants are prohibited from receiving CSFP benefits and WIC benefits at the same time. However, there is no prohibition against simultaneous participation in CSFP and other FNS programs including but not limited to SNAP, TEFAP, and the SFMNP, provided the eligibility requirements for these programs are met.
The purpose of this pilot was to test possible methods that could lead to valid estimations of the number of meals served by family day care homes. The estimated number of meals served can be used to develop estimates of over- and under-counts of meal claims that result in erroneous payments.
This memorandum is being issued to emphasize that states may use TEFAP administrative funds to pay for direct and indirect expenses associated with both the distribution of TEFAP foods and of foods secured from other non-federal sources. Foods secured from other sources is defined as any foods not obtained from USDA food assistance programs.
CACFP funds are provided to assist state agencies through grants and other means to initiate and maintain nonprofit food service programs for eligible children and adult participants in nonresidential institutions that provide care. This Instruction establishes program standards, principles and guidelines for financial management.
This policy memorandum is the result of activities undertaken to plan a government-wide response to a potential human pandemic and addresses the operation of its USDA food programs during a major pandemic event.
