This Instruction prohibits the denial of meals and milk as a disciplinary action against any child who is enrolled in a school participating in the Chile Nutrition Programs. Such denial of meals or milk is inconsistent with Section 2 and 9 of the National School Lunch Act and Sections 2,3, and 4 of the Child Nutrition Act of 1966.

Applications of sponsors who are currently under investigation or audit or which have outstanding obligations related to their prior participation in the Summer Food Service Program should be evaluated on a case-by-case basis.

A state agency may make payment for meals served in accordance with provisions of the program in the calendar month preceding the calendar month in which the agreement is executed. This provision applies only to center programs and to home programs which are renewing their agreements. The agreements of new home sponsoring organizations may not be backdated.
