This memorandum provides guidance on the process state agencies and SFAs should use when assessing requests to fund nutrition education related expenses from the nonprofit school food service account.

FNS considers access to a healthy school meal a critical function of child nutrition programs. FNS Instruction 782-6 established the longstanding policy that children participating in the school meal programs not be charged any additional fees for services provided in conjunction with the delivery of these programs.

This memorandum provides additional guidance to assist in implementing the final rule, Administrative Reviews in School Nutrition Programs, effective Sept. 27, 2016. The guidance included in this memorandum is intended to assist with the completion of administrative reviews conducted after this effective date.

The purpose of this memorandum is to provide guidance regarding state agency responsibilities to establish limitations on the frequency of specially exempted fundraisers in schools.

This Instruction sets forth the policy regarding fees, other than the basic meal charge, assessed against children participating in the National School Lunch, School Breakfast, and Special Milk Programs to support the meal or milk service.

The attached memorandum is Food Distribution Policy Memo FD-110, which clarifies requirements in crediting for, and use of, USDA donated foods in contracts with food service management companies, and provides guidance to ensure compliance with such requirements in the first and final years of such contracts.

This policy memorandum consolidates requirements for the SDA when reporting the distribution of donated foods, and when requesting the replacement of such foods, in disasters, emergencies and situations of distress. 

This policy memorandum clarifies the audit-related tracking and notification requirements for TEFAP state agencies and Eligible Recipient Agencies that further distribute or pass-through TEFAP food or funds to ERAs and are subject to audit requirements under 7 CFR Part 3052.
