The Personal Responsibility and Work Opportunity Reconciliation Act of 1996 made a number of changes to the National School Lunch Act which governs the waiver process in the child nutrition programs. This memorandum identifies the changes and provides guidance to be used in developing and submitting waiver requests to the child nutrition division.
This memorandum addresses provisions which reduce the number of reimbursable meals that can be claimed by camps and migrant site in SFSP and child care centers in CACFP.

This is to provide you with clarification concerning the use of farmer and market identifiers on FMNP coupons. FMNP regulations require that each coupon be marked with a farmer identifier.

Because some aspects of this year's FMNP season have already begun, and the process of issuing regulations is long and complex, we wanted to offer state agencies the opportunity to implement the following provisions prior to publication of the final FMNP regulation.
We have concluded that neither the authorization of farmers or farmers' markets nor the exchange of a FMNP coupon between a certified FMNP recipient and an approved farmer or farmers' markets in the FMNP represents "covered transactions." Therefore, farmers or farmers' markets in the FMNP are not subject to the certification requirements.
This policy memorandum authorizes the implementation of the provisions contained in PL 103-448, the Healthy Meals for Healthy Americans Act of 1994, enacted on Nov. 2, 1994.
The National Association of Farmers' Market Nutrition Program directors held their first annual meeting in Baltimore, MD, on Oct. 7-9, 1993. This policy is intended to clarify the issue of Farmers' Market Nutrition Program (FMNP) administrative funds for training and meetings and conferences as allowable administrative costs, as well as the circumstances under which WIC or FMNP administrative funds may be used.
Section 10 of the Child Nutrition Act of 1966 permits the Secretary to authorize any state or regional office, where applicable, to reserve up to 1 percent of the funds earned in any fiscal year under both the National School Lunch Act and the CNA for special developmental projects.
