USDA is committed to providing nutrition assistance to hard-hit families across the country due to the coronavirus pandemic. The Consolidated Appropriations Act 2023 authorized a permanent, nationwide Summer EBT program beginning in 2024. The Act requires FNS to promulgate interim regulations within a year of the Act’s enactment. Interim regulations are effective upon publication and FNS will accept comments on the interim rule to inform subsequent rulemakings.

On January 22, in support of President Biden’s call to action on hunger, USDA announced that it is increasing the Pandemic-EBT (P-EBT) benefit by approximately 15 percent, providing more money for low-income families and millions of children missing meals due to school and child care closures.

In school year 2013-14, FNS introduced the unified administrative review and a 3-year review cycle. Since then, FNS has received feedback about the difficulties of the shorter review cycle, both for the state agencies conducting the reviews, and for school food authorities preparing for and responding to reviews.

The purpose of this memorandum is to provide guidance for state agencies and program operators on the status of nationwide waivers of statutory and regulatory requirements in the Summer Food Service Program.
