Under this waiver, for all states, Summer Food Service Program and National School Lunch Program Seamless Summer Option closed enrolled sites during the COVID-19 public health emergency may determine site eligibility through area eligibility without collecting income eligibility applications.

This waiver extends until Dec. 31, 2020, the Nationwide Waiver to Extend Area Eligibility Waivers. 

FNS is establishing a nationwide waiver to extend area eligibility waivers through Aug. 31, 2020 to continue supporting access to nutritious meals while minimizing potential exposure to the novel coronavirus (COVID-19).

This instruction establishes the general standards and procedures that the state distributing agency, Indian Tribal Organization, or other consignee must follow in receiving shipments of USDA Foods, and conveys established responsibilities for other entities such as USDA Foods vendors and carriers.

SFSP is administered at the federal level by FNS. FNS decides overall program policy and publishes regulations and payment rates.

School food authorities (SFAs) participating in the National School Lunch and School Breakfast programs are required to verify income for a small percentage of households approved for free or reduced price meals each school year. However, getting households to respond to verification requests can be challenging for SFA staff. If households do not respond, they lose their benefits regardless of their actual eligibility.

The purpose of this memorandum is to provide guidance for state agencies and program operators on the status of nationwide waivers of statutory and regulatory requirements in the Summer Food Service Program.
