The purpose of this memo is to highlight previously issued guidance on the disclosure of eligibility information between child nutrition programs, and to offer clarification on the application of this policy.
In an effort to provide administrative relief to state agencies and Summer Food Service Program sponsoring organizations, we are extending to the SFSP a provision of the CACFP that allows state agencies and institutions to rely upon a determination of area eligibility for up to five years when based on National School Lunch Program data.
It has come to our attention that there may be some confusion concerning fluid milk, and how it is offered in reimbursable lunches. Under all menu planning approaches, fluid milk is a separate food component/menu item.
The Richard B. Russell National School Lunch Act was amended by the Child Nutrition and WIC Reauthorization Act of 2004 to specify verification sample sizes for local educational agencies .

The Child Nutrition and WIC Reauthorization Act of 2004 amended sections of the Richard B. Russell National School Lunch Act affecting the eligibility determination process for free and reduced price benefits under the National School Lunch Program, School Breakfast Program and the Special Milk Program for Children.
The Child Nutrition and WIC Reauthorization Act of 2004 requires that children in food stamp households be directly certified for free school meals. To prepare for the phased in implementation of mandatory direct certification, which begins for the largest school districts in July 2006 and covers all school districts by July 2008, we convened a work group on Jan. 26–27, 2005.
