FNS is aware that schools in multiple states are experiencing milk supply chain challenges related to packaging issues. This memorandum provides state agencies with information about existing authority related to schools and other child nutrition program operators experiencing inadequate milk supply. FNS encourages state agencies to use this authority when needed to support program operators impacted by the current milk packaging challenges. 

A webinar for state agency and school food authority staff focused on the Final Rule: Child Nutrition Programs Community Eligibility Provision — Increasing Options for Schools. 

This final rule amends the Community Eligibility Provision (CEP) regulations by lowering the minimum identified student percentage (ISP) from 40 percent to 25 percent. 

USDA published a final rule in the Federal Register on Sept. 26, 2023, to expand access to the Community Eligibility Provision by lowering the minimum identified student percentage participation threshold from 40 percent to 25 percent. 

The Menu Planner for School Meals has been revised to reflect the Child Nutrition Programs: Transitional Standards for Milk, Whole Grains, and Sodium Final Rule that was published in February 2022.

This memorandum provides initial implementation guidance for the Child Nutrition Program Integrity Final Rule. This memorandum applies to state agencies administering and school food authorities, institutions and sponsors implementing the NSLP, SBP, CACFP, and SFSP.

This action implements statutory requirements and policy improvements to strengthen administrative oversight and operational performance of the Child Nutrition Programs.

​The COVID-19 pandemic significantly impacted school meal operations and has contributed to lasting supply chain issues affecting the cost and availability of food and labor. The School Food Authority Survey II on Supply Chain Disruption and Student Participation was administered to all SFAs operating child nutrition programs in schools to gather information on the impacts of continued supply chain disruptions and the return to standard operations during SY 2022–23.

The Child Nutrition Database is a required part of the nutrient analysis software approved by USDA for use in the National School Lunch Program and School Breakfast Program. It is a nutrient database of over 9,000 food items.

The purpose of this new collection is to collect qualitative and quantitative stakeholder feedback through meetings, focus groups, interviews, other stakeholder interactions and surveys, as well as requests for administrative data, as part of the planning process for FNS regulatory actions, the semi-annual regulatory agenda, research studies, outreach, training and the development of guidance.
