This memorandum provides initial implementation guidance for the Child Nutrition Program Integrity Final Rule. This memorandum applies to state agencies administering and school food authorities, institutions and sponsors implementing the NSLP, SBP, CACFP, and SFSP.

Professional Standards for school nutrition professionals is a key provision of the Healthy, Hunger-Free Kids Act of 2010. The final rule, published March 2, 2015, requires a minimum amount of annual training hours for all state directors of school nutrition programs, state director of distributing agencies, school nutrition program directors, managers, and staff.

The Healthy, Hunger-Free Kids Act of 2010 added a new Section 23 on Childhood Hunger Research to the Richard B. Russell National School Lunch Act. This section provides substantial new mandatory funding to research the causes and consequences of childhood hunger and to test innovative strategies to end child hunger and food insecurity.

The final rule titled Local School Wellness Policy Implementation Under the Healthy, Hunger-Free Kids Act of 2010 was published on July 29, 2016. The Office of Management and Budget (OMB) cleared the associated information collection requirements on Sept. 12, 2016. This document announces approval of the ICR.

The information in this second year report (school year 2012-13), the first year new lunch standards were implemented, will provide data for observing the improvements resulting from the implementation of the Healthy, Hunger-Free Kids Act. Data was collected from a survey of all state child nutrition directors and a nationally representative sample of school food authorities.

This rule adopts as final, with some modifications, the National School Lunch Program and School Breakfast Program regulations set forth in the interim final rule published in the Federal Register on June 28, 2013. The requirements addressed in this rule conform to the provisions in the Healthy, Hunger-Free Kids Act of 2010 regarding nutrition standards for all foods sold in schools, other than food sold under the lunch and breakfast programs.
