This letter provides information to WIC state agencies and WIC Farmers’ Market Nutrition Program state agencies on available American Rescue Plan Act of 2021 waivers and a new state agency request process.

The American Rescue Plan Act of 2021 provided USDA with $390 million, available through FY 2024, to carry out outreach, innovation, and program modernization efforts to increase participation and redemption of benefits for both the WIC program and the WIC Farmers’ Market Nutrition Program.

This memo transmits updates to the maximum size of WIC civil monetary penalties to reflect inflationary adjustments for 2022, as required by the Federal Civil Penalties Inflation Adjustment Improvements Act of 2015. 

This policy memorandum transmits the Civil Monetary Penalty (CMP) inflation adjustment for 2021 for the Special Supplemental Nutrition Program for Women, Infants, and Children (WIC). This collection is an extension, without change, of a currently approved collection for the maintenance of a central repository containing information about authorized foods in the Special Supplemental Nutrition Program for Women, Infants and Children, as approved by various WIC state agencies.

This final rule amends regulations for the Special Supplemental Nutrition Program for Women, Infants and Children by adding three requirements mandated by the Child Nutrition and WIC Reauthorization Act of 2004 in amendments to the Child Nutrition Act of 1966 concerning retail vendors authorized by WIC state agencies to provide supplemental food to WIC participants in exchange for WIC food instruments.
