This memorandum establishes the procedure for accounting for rework in the further processing of donated foods.

This memorandum establishes the policy and procedures to compensate offshore destinations for the marine shipping costs associated with further processed end products. Offshore destinations are defined as those state agencies that are not located in the 48 contiguous United States.

Questions have arisen regarding the eligibility for reimbursement of meals served to children who are placed by a public school district in special schools or institutions which are either not eligible to participate or choose not to participate in the NSLP and/or SBP.

Please advise your state agencies that a January 2002 amendment to the McKinney-Vento Homeless Assistance Act clarified the definition of homeless children and youth. Another provision of the statute requires each school district to designate a local educational agency liaison for homeless children and youths. 

The Personal Responsibility and Work Opportunity Reconciliation Act of 1996 made a number of changes to the National School Lunch Act which governs the waiver process in the child nutrition programs. This memorandum identifies the changes and provides guidance to be used in developing and submitting waiver requests to the child nutrition division. 

This Instruction sets forth the policy with respect to reimbursement of meals consumed off-site under the National School Lunch, Commodity School, and School Breakfast Programs.
