The purpose of this policy memorandum is to clarify the responsibilities of the state administering agency and the state distributing agency with respect to ensuring compliance with requirements for donated foods in the National School Lunch Program, the Summer Food Service Program and the Child and Adult Care Food Program.
In this memorandum, we present several options for consideration by the distributing agency to help ensure that service institutions receive donated foods for use in the summer meals provided in SFSP in an efficient and cost-effective manner.
The purpose of this memo is to highlight previously issued guidance on the disclosure of eligibility information between child nutrition programs, and to offer clarification on the application of this policy.
In an effort to provide administrative relief to state agencies and Summer Food Service Program sponsoring organizations, we are extending to the SFSP a provision of the CACFP that allows state agencies and institutions to rely upon a determination of area eligibility for up to five years when based on National School Lunch Program data.
The Richard B. Russell National School Lunch Act requires that, when a single state agency administers the National School Lunch Program and any other child nutrition program, the state must have a single agreement and claim form for any school food authority which administer any combination of the programs.
Local educational agencies must verify applications in accordance with the procedures set forth in the above-cited memorandum. The above change will affect the reporting for Item 6 on the FNS-742, School Food Authority Verification Summary Report.
It has come to our attention that a number of state agencies and school food authorities are failing to maintain appropriate records for procurement transactions occurring in connection with the child nutrition programs.
As you know, in August 2000, the procurement requirements for the child nutrition programs were moved from Department regulation 7 CFR Part 3015 to 7 CFR Parts 3016 and 3019. Attached are a number of questions and answers we have received concerning how these requirements changed the procedures for procurements paid with State Administrative Expense Funds.
