This rulemaking proposes important modifications to make the application of serious deficiency procedures in the Child and Adult Care Food Program and Summer Food Service Program consistent, effective, and in line with current requirements under the Richard B. Russell National School Lunch Act. 

This memorandum includes key information on the new regulatory requirements for non-congregate summer meal service in rural areas.

This study will conduct case studies in up to five states to understand the challenges with improving program coordination and highlight the best practices that could be shared with other states.

Through this rulemaking, FNS aims to improve the quality of race and ethnicity data collected and to ensure program benefits are distributed without regard to race, color, or national origin.

FNS is aware that schools in multiple states are experiencing milk supply chain challenges related to packaging issues. This memorandum provides state agencies with information about existing authority related to schools and other child nutrition program operators experiencing inadequate milk supply. FNS encourages state agencies to use this authority when needed to support program operators impacted by the current milk packaging challenges. 

On Sept. 30, 2023, President Biden signed into law the Continuing Appropriations Act, 2024 and Other Extensions Act, funding the federal government through Nov. 17, 2023. This memorandum is intended to clarify the impact of the continuing resolution on upcoming SNAP benefit issuance.

The purpose of this guide is to consolidate guidance and policy on serving able-bodied adults without dependents (ABAWDs).

This guidance updates previously issued Questions and Answers to clarify SFSP requirements. It supersedes SFSP 05-2017, Summer Food Service Program Questions and Answers, Dec. 1, 2016.

This guidance applies to state agencies and local educational agencies administering the National School Lunch Program and the School Breakfast Program. This guidance provides information on the final rule, Child Nutrition Programs: Community Eligibility Provision – Increasing Options for School.

FNS has estimated the number of new discretionary exemptions each state has earned for FY 2024. States that operated under a statewide waiver of the ABAWD time limit did not earn any new exemptions.
