SUBJECT: Payments to Certain Filipino World War II Veterans - Exclusion from Income and Resources
TO: Regional Directors
Supplemental Nutrition Assistance Program
All Regions

The American Recovery and Reinvestment Act of 2009 (PL 111-5) created the Filipino Veterans Equity Compensation Fund for certain veterans, or surviving spouses of veterans, who served in the military of the Government of the Commonwealth of the Philippines during World War II. Section 1002(c) of PL 111-5 directs the Secretary of Veterans Affairs to provide one-time payments of up to $15,000 to eligible persons.

Section 1002(g) of PL 111-5 provides that these payments shall not be included as income or resources for purposes of determining the eligibility of an individual for, or the amount of benefits under, any federal or federally assisted program. Therefore, Filipino Veterans Equity Compensation Fund payments must not be counted as income or as a resource in determining eligibility for the Special Supplemental Nutrition Program for Women, Infants and Children.

The complete text of the law is available at: https://www.govinfo.gov/content/pkg/PLAW-111publ5/pdf/PLAW-111publ5.pdf

For questions or assistance in implementing this income exclusion, state agencies should contact their respective Food and Nutrition Service regional offices.
