Under Section 7(h)(9) of the Food and Nutrition Act of 2008, as amended (the Act), states have the option to require that a SNAP Electronic Benefit Transfer card contains a photo of one or more household members.

This memorandum provides the fiscal year (FY) 2016 Cost-of-Living Adjustments (COLA) to the Supplemental Nutrition Assistance Program (SNAP) maximum allotments, income eligibility standards, and deductions. Section 6(0) of the Food and Nutrition Act of 2008 limits ABAWD eligibility for the SNAP to 3 months in any 36-month period, unless the individual meets the ABAWD work requirement or is otherwise exempt. FNS is providing the attached guidance in response to recent questions from state agencies concerning ABAWD policy.

The law also provides that states may qualify to temporarily waive the 3-month time limit in areas with high unemployment or depressed labor markets.

This memorandum is intended to clarify FNS policy regarding men who are victims of domestic violence residing in shelters for battered women and children, which will henceforth be referred to as shelters for battered persons. Both the Food and Nutrition Act of 2008, as amended (the Act), and SNAP regulations allow certain flexibilities for victims of domestic violence who are fleeing their abuser.

The Agricultural Act of 2014 set the Quality Control tolerance level for excluding small errors at up to $37 for FY 2014. In addition, the Act requires FNS to adjust the tolerance level for future years by the percentage by which the Thrifty Food Plan is adjusted under the Food and Nutrition Act of 2008.
