Resource WIC Income Eligibility Guidelines (2008-2009)

The Department announces adjusted income eligibility guidelines to be used by state agencies in determining the income eligibility of persons applying to participate in the WIC program. These income eligibility guidelines are to be used in conjunction with the WIC regulations.

In light of recent legislative changes, FNS is issuing the following new guidance on the eligibility of Iraqi and Afghani special immigrants. Due to these changes in legislation, Iraqis are now treated somewhat differently than Afghanis. Because FNS has updated its policy interpretation on how to treat these special immigrants, this new guidance supersedes our previous guidance on Iraqi and Afghani Special immigrants issued on Jan. 24, 2008.

The Child Nutrition and WIC Reauthorization Act of 2004 authorized a pilot to operate in rural Pennsylvania during the summers of 2005 and 2006. The purpose was to test whether lowering the site eligibility threshold from 50 percent to 40 percent would increase the number of children participating in the program.

The Consolidated Appropriations Act of 2008 granted Iraqi and Afghan aliens special immigrant status under the Immigration and Nationality Act. Individuals and family members granted this special immigrant status are eligible for resettlement assistance, entitlement programs, and other benefits the same as refugees admitted under the INA, except the period of eligibility cannot exceed six months.

Program errors and the risk of erroneous payments in the National School Lunch Program (NSLP) and School Breakfast Program (SBP) continue to be a concern. Slightly more than one in five students were certified inaccurately or erroneously denied benefits in school year (SY) 2005-06. New data estimates the gross cost of school meals erroneous payments due to certification error at about $935 million while other operational errors represent about $860 million.
