USDA intends to use all available program flexibilities and contingencies to serve our program participants across our 15 nutrition programs. We have already begun to issue waivers to ease program operations and protect the health of participants.

Consolidated Appropriations Act 2021 - Effect on Child Nutrition Programs

This memorandum provides notice to child nutrition program operators that the Consolidated Appropriations Act 2021 allows the substitution of vegetables for fruits under the school breakfast program; prohibits funds from being used to procure raw or processed poultry products from the People’s Republic of China; provides guidance related to pricing of paid lunches for the school lunch program during SY 2021-2022; and allows the offering of low-fat (1% fat) flavored milk in the school lunch and school breakfast programs.

Nationwide Waiver to Allow Specific School Meal Pattern Flexibility for School Year 2021-2022

FNS waives, for all states, the requirements to serve meals that meet specified meal pattern requirements during the public health emergency due to COVID–19. This waiver applies to state agencies administering and local organizations operating the National School Lunch Program and School Breakfast Program. These flexibilities also apply to the National School Lunch Program Seamless Summer Option.

Under this waiver, Child and Adult Care Food Program operators in states that elect to be subject to this waiver may serve meals that do not meet specified meal pattern requirements during the public health emergency due to COVID-19.

This waiver revises the Nationwide Waiver to Allow Meal Pattern Flexibility in the Child Nutrition Programs – Extention #4 granted on June 25, 2020, for all programs except the Summer Food Service Program.
