Nationwide Waiver of 60 Day Reporting Requirements for January and February 2020

Pursuant to the COVID–19 Child Nutrition Response Act (H.R. 6201, Title II), and based on the exceptional circumstances of this public health emergency, the Food and Nutrition Service is granting a nationwide waiver to help minimize potential exposure to the novel coronavirus. This waiver applies to the National School Lunch Program, the School Breakfast Program, the Special Milk Program, the Child and Adult Food Care Program, and the Summer Food Service Program.

The Emergency Food Assistance Program (TEFAP) Flexibilities for State Agencies

During an emergency situation such as the COVID-19 public health emergency, there are flexibilities available to TEFAP state agencies to assist them in continuing to provide food to people in need. TEFAP is available to assist current participants and those who may become newly eligible for the program. Implementing TEFAP flexibilities can be achieved simply by submitting a written explanation (i.e., state plan amendment) to the FNS regional office for expedited review and approval.

Nationwide Waivers of Child Nutrition Monitoring

FNS has used its authority under FFRCA to waive certain onsite monitoring requirements for the school meals programs, the Child and Adult Care Food Program, and the Summer Food Service Program, so that programs can to maintain program integrity and support social distancing while providing meals.

D-SNAP State Workgroup Recommendations

The FNS Southwest Regional Office convened a state workgroup comprised of seven state agencies with recent disaster experience to discuss concerns and best practices regarding D-SNAP implementation, program integrity, and program access. State representatives from across the country met with FNS leadership to review current statues, regulatory provisions, and policy guidance concerning D-SNAP, and to provide recommendations to FNS on how to improve the program at state and federal levels.

Special Disaster Rules for Accepting SNAP EBT Benefits for Hot Food Purchases

Due to the power outages, severe flooding and displacements from homes caused by the Kilauea Volcanic Eruption, and effective immediately, retail food stores licensed by the Food and Nutrition Service and located in Hawaii County may accept SNAP benefits in exchange for HOT foods and foods intended to be consumed on retailer premises.

Providing Child Nutrition Program Benefits to Disaster Survivor Evacuees

This memorandum provides a reminder overview of options available under current program policy and regulation for connecting children and adult survivors, who have evacuated from areas subject to major disaster and emergency declarations, with child nutrition program (CNP) benefits. Many survivors have evacuated as a result of the recent hurricanes and wildfires and program operators are working hard to enroll and provide services for those evacuees.

Disaster Response

This memorandum supersedes SP 25-2012, CACFP 12-2012, SFSP 10-2012, Disaster Response and provides an overview of ways State agencies, school food authorities (SFAs) participating in the National School Lunch (NSLP) and School Breakfast Programs (SBP), institutions participating in the Child and Adult Care Food Program (CACFP), and sponsors participating in the Summer Food Service Program (SFSP) can respond to situations resulting from damage or disruptions due to natural disasters such as hurricanes, tornadoes, and flood as well as other exceptional emergency situations or man-made disasters.
