Crediting Coconut, Hominy, Corn Masa, and Masa Harina in the Child Nutrition Programs

This memorandum rescinds and replaces SP 22-2019, CACFP 09-2019, SFSP 08-2019 Crediting Coconut, Hominy, Corn Masa, and Corn Flour in the Child Nutrition Programs. This updated memorandum provides guidance on crediting coconut (including dried coconut), hominy, corn masa, and masa harina and clarifies how to identify popular products made from corn that can credit towards the grain requirements in the child nutrition programs (CNPs), including the National School Lunch Program (NSLP), School Breakfast Program (SBP), Child and Adult Care Food Program (CACFP), and Summer Food Service Program (SFSP).

Identity Authentication Pilot Projects – Conversion to State Option

Federal law requires State agencies to verify a Supplemental Nutrition Assistance Program (SNAP) applicant's identity and other critical information prior to · certifying the household to participate in SNAP. In general, SNAP State agencies verify identity based on documentary evidence, such as a driver's license, obtained through the applicant or a third party. However, over the last 6 years, the Food and Nutrition Service (FNS) has conditionally permitted several State agencies to establish and conduct Identity Authentication Pilot projects. As a result of the projects' success in providing an innovative way for SNAP State agencies to provide maximum flexibility to utilize technology in streamlining program administration, FNS is now providing all State agencies the option to use Identity Authentication in verifying applicant identity.

Buy American and the Agriculture Improvement Act of 2018

This memorandum addresses information in the Agriculture Improvement Act of 2018 regarding the Buy American requirements in the national school meal programs. The Richard B. Russell National School Lunch Act (Section 12(n), 42 USC 1760(n)), requires school food authorities to purchase, to the maximum extent practicable, domestic commodities or products. This provision supports the mission of the child nutrition programs, which is to serve children nutritious meals and support American agriculture.

Farm Bill Implementation Memo: Donated Traditional Foods and Civil Liability

On Dec. 20, 2018, Congress passed the Agriculture Improvement Act of 2018 (P.L. 115-334, 2018 Farm Bill). The purpose of this memorandum is to notify Child Nutrition Program operators of the 2018 Farm Bill’s expansion of the provision stating that certain groups are not liable in civil cases regarding the donation and service of traditional foods. This provision only applies to food service programs at public and nonprofit facilities that primarily serve Indians, including those operated by Indian Tribes and Tribal organizations.

Reminder: Requirements for Students Transferring from Provision to non-Provision Schools

On July 29, 2016, USDA's Food and Nutrition Service published the final rule “National School Lunch Program and School Breakfast Program: Eliminating Applications Through Community Eligibility as Required by the Healthy, Hunger-Free Kids Act of 2010” (81 FR 50194). This memorandum reminds state and local program operators about a provision in the final rule effective on July 1, 2019, relating to free and reduced price eligibility for students transferring between LEAs during the school year.

Paid Lunch Equity: Guidance for School Year 2019-20

In Section 760 of the Consolidated Appropriations Act, 2019 , Congress provides that only school food authorities that had a negative balance in the nonprofit school food service account as of December 31, 2018, shall be required to establish prices for paid lunches according to the Paid Lunch Equity provisions in Section 12(p) of the Richard B. Russell National School Lunch Act, 42 U.S.C. 1760(p) and implemented in National School Lunch Program regulations at 7 CFR 210.14(e).
