This interim rule amends the regulations on eligibility determinations for free and reduced price school meals to implement nondiscretionary provisions of the Child Nutrition and WIC Reauthorization Act of 2004.

This proposed rule would implement a legislative provision on milk substitutes that follows current regulations on menu exceptions for students with disabilities and would add new requirements for substitutions for fluid milk for children with medical or other special dietary needs.
This rule implements a provision of the Act that increases the minimum State Administrative Expense grant for each state administering the National School Lunch Program, the School Breakfast Program and/or the Special Milk Program from $100,000 to $200,000 a year, adjusted by an index beginning in FY 2009.
