Consolidated Appropriations Act 2021 - Effect on Child Nutrition Programs

This memorandum provides notice to child nutrition program operators that the Consolidated Appropriations Act 2021 allows the substitution of vegetables for fruits under the school breakfast program; prohibits funds from being used to procure raw or processed poultry products from the People’s Republic of China; provides guidance related to pricing of paid lunches for the school lunch program during SY 2021-2022; and allows the offering of low-fat (1% fat) flavored milk in the school lunch and school breakfast programs.

Nationwide Waiver to Allow Meal Pattern Flexibility - Extension 2

FNS is extending a nationwide waiver to support access to nutritious meals while minimizing potential exposure to the novel coronavirus (COVID–19). This extension of Nationwide Waiver to Allow Meal Pattern Flexibility in the child nutrition programs, issued March 25, 2020, applies to the National School Lunch Program, School Breakfast Program, Child and Adult Care Food Program, and Summer Food Service Program. This waiver remains in effect until June 30, 2020.

Further Clarification in Crediting for, and Use of, Donated Foods in Contracts with Food Service Management Companies

The attached memorandum is Food Distribution Policy Memo FD-110, which clarifies requirements in crediting for, and use of, USDA donated foods in contracts with food service management companies (FSMCs), and provides guidance to ensure compliance with such requirements in the first and final years of such contracts.
