Nationwide Waivers of Child Nutrition Monitoring

FNS has used its authority under FFRCA to waive certain onsite monitoring requirements for the school meals programs, the Child and Adult Care Food Program, and the Summer Food Service Program, so that programs can to maintain program integrity and support social distancing while providing meals.

This extension of Nationwide Waiver of Onsite Monitoring Requirements in the School Meals Programs
– EXTENSION, issued June 8, 2020 to waive the requirements until Aug.  31, 2020 applies to the National School Lunch Program and the School Breakfast Program. The onsite monitoring portion of this waiver remains in effect through June 30, 2021.

This waiver allows for offsite monitoring in addition to the flexibilities provided for sponsors in the extension of COVID-19 Child Nutrition Response #27: Nationwide Waiver of Monitoring Requirements for Sponsors in the Child and Adult Care Food Program, issued June 8, 2020 and effective through Aug. 31, 2020. This waiver is effective immediately, and remains in effect through Sept. 30, 2021.

Nationwide Waiver to Allow Meal Pattern Flexibility in the Child Nutrition Programs – Extension 5

Pursuant to section 2202(a) of the Families First Coronavirus Response Act and in light of the exceptional circumstances of this public health emergency,  FNS is extending a nationwide waiver to support access to nutritious meals while minimizing potential exposure to the novel coronavirus (COVID–19).

Temporary Suspension of Claims Collections Guidance

FNS will allow state agencies to suspend SNAP regulations at 7 CFR 273.18(d) by allowing flexibility in the time frame for establishing or disposing of new claims as well as SNAP regulations at 7 CFR 273.18(e)(1) and (e)(5) by not requiring collection of active recoupment of SNAP overpayments, delaying collection on newly established overpayments, and not considering any payments delayed due to this suspension to be delinquent.

Food Determinations – Eligible Food (Excluding Meal Services)

This memorandum clarifies policy related to "eligible foods," which are foods and other items that may be purchased with Supplemental Nutrition Assistance Program (SNAP) benefits. Section 3(k) of the Food and Nutrition Act of 2008 (the Act) and SNAP regulations at 7 CFR § 271.2 define eligible foods. This memorandum does not address meals that may be purchased with SNAP benefits from firms authorized to serve such meals, although these meals are also eligible foods.
