Attached are revised Questions and Answers related to the final rule entitled, Certification of Compliance with Meal Requirements for the National School Lunch Program under the Healthy, Hunger-Free Kids Act of 2010.

This final rule adopts, with some revisions, changes to the NSLP regulations, as set forth in the interim final rule published in the Federal Register on April 27, 2012. The changes conform to requirements contained in the Healthy, Hunger- Free Kids Act of 2010 regarding performance-based cash assistance for school food authorities certified compliant with meal pattern and nutrition standards.

This memorandum provides updated questions and answers to the Child Nutrition Reauthorization 2010 implementation memorandum SP 39-2011, Guidance on Paid Lunch Equity and Revenue from Nonprogram Foods.

This final rule incorporates into the regulations governing the programs authorized under the Richard B. Russell National School Lunch Act (NSLA) and the Child Nutrition Act of 1966 (CNA) two nondiscretionary provisions of the Healthy, Hunger-Free Kids Act of 2010 (HHFK Act).

The purpose of this memorandum is to implement provisions contained in the Healthy, Hunger-Free Kids Act of 2010 which establish direct certification rate benchmarks for states and require continuous improvement plans from states that do not meet the benchmarks.

The Healthy, Hunger-Free Kids Act of 2010 modifies requirements for fluid milk in the National School Lunch Program and School Breakfast Program. The purpose of this memorandum is to provide guidance on the implementation of these modifications.

The Healthy, Hunger-Free Kids Act of 2010  clarifies requirements for participation in evaluations and research in the child nutrition programs. The purpose of this memorandum is to provide guidance on the implementation of this provision

This memorandum provides information relating to section 205 of the Healthy, Hunger-Free Kids Act of 2010. This provision requires school food authorities (SFAs) participating in the National School Lunch Program to ensure that schools are providing the same level of support for lunches served to students who are not eligible for free or reduced price lunches (i.e., paid lunches) as they are for lunches served to students eligible for free lunches.

The Healthy, Hunger-Free Kids Act of 2010 amends statutory requirements for collection of social security numbers in all child nutrition programs. The purpose of this memorandum is to provide guidance on the implementation of this requirement.

The Healthy, Hunger-Free Kids Act of 2010 modifies requirements for permanent agreements in the Summer Food Service Program and the Child and Adult Care Food Program. The purpose of this memorandum is to implement these modifications to the SFSP and CACFP.
