PL 104-193: Changes to Applications for Waivers in the Child Nutrition Programs

PL 104-193, the Personal Responsibility and Work Opportunity Reconciliation Act of 1996, was signed by the President on Aug. 22, 1996. Section 705(f) of that legislation made a number of changes to Section 12(1) of the National School Lunch Act which governs the waiver process in the Child Nutrition Programs. This memorandum identifies the changes made by PL 104-193 and provides guidance to be used in developing and submitting waiver requests to the Child Nutrition Division.

Questions and Answers Concerning PL 104-193: Two-tier Reimbursement Structure for Family Day Care Homes (FDCHs) Participating in the Child Adult Care Food Program (CACFP)

Attached are answers to a series of questions which we have received concerning the new two-tiered reimbursement system mandated for FDCHs in the CACFP. All of these answers are based strictly on the provisions of the law; they do not address additional questions which we have received but will be unable to answer until after publication of the interim rule on this new reimbursement system.

Recently, we were asked whether State agencies (SAs) are required to make public release announcements on behalf of their CACFP institutions. Criteria for Sponsoring Organizations under the Child and Adult Care Food Program (CACFP) Exempt Organizations Handbook, Section 34 (14)

On Oct. 10, 1995, we transmitted questions to the Internal Revenue Service (IRS) regarding concerns raised by State administrators of the CACFP and re-emphasized by the State and Federal representatives at the September 1995  CACFP Initiative Task Force meeting held here at headquarters. These concerns related to the recent revision to the criteria for granting tax exemption to sponsoring organizations of family day care homes from the IRS’s Exempt Organizations Handbook (EOH) Section 34(14).  The attachment repeats our questions to IRS and their response to those questions.
