To implement this new law, states are working quickly to develop and implement processes to help people whose SNAP benefits were stolen seek and obtain relief. USDA is aware of increased reports of EBT theft due to card skimming, cloning, and similar fraudulent methods. On Dec. 29, 2022, President Joseph R. Biden signed into law the Consolidated Appropriations Act, 2023 (the Omnibus), which includes provisions for the replacement of stolen EBT benefits with federal funds.
This memorandum describes the provisions of the Extending Government Funding and Delivering Emergency Assistance Act that affect SNAP. Section 2502 of the Act provides that Afghan nationals, citizens, or those who last habitually lived in Afghanistan who are granted parole between July 31, 2021, and Sept. 30, 2022, are eligible to receive resettlement assistance, entitlement programs (including SNAP), and other benefits available to refugees admitted under section 207 of the Immigration and Nationality Act.
USDA's FNS and ACF at the Department of Health and Human Services are aware of increasing reports of benefit theft by criminal actors through EBT card skimming schemes. After discussions with EBT processors and fraud prevention stakeholders, FNS and ACF have identified prevention measures that can be adopted to improve card security while we work towards longer-term strategies.
This memorandum provides implementation guidance for Sec. 401 of the “Additional Ukraine Supplemental Appropriations Act, 2022,” signed into law on May 21, 2022. Sec. 401 extends SNAP eligibility to certain Ukrainian parolees.

States have long served as incubators for testing strategies to help prevent program fraud. Based on an FNS partnership with 10 states, the "SNAP Fraud Framework" combines innovations in the use of analytics with concepts and practices from industry in order to more effectively detect potential fraud and improve administration and oversight.
