Consolidation of Reporting Requirements and Replacement of Donated Foods in Disasters, Emergencies, and Situations of Distress

This policy memorandum consolidates requirements for the state distributing agency when reporting the distribution of donated foods, and when requesting the replacement of such foods, in Presidentially-declared disasters and emergencies (hereinafter referred to as disasters), and in situations of distress. In addition, this policy memorandum clarifies that applications submitted by disaster organizations for distribution of donated foods to households must include a description of the methods of distribution available in both disasters and situations of distress.

Final Rule: School Food Safety Program Based on Hazard Analysis and Critical Control Point Principles - Approval of Information Collection Request

The final rule entitled School Food Safety Program Based on Hazard Analysis and Critical Control Point Principles (HACCP) was published on Dec. 15, 2009, which implemented a legislative provision requiring school food authorities participating in the National School Lunch Program (NSLP) or the School Breakfast Program (SBP) to develop a school food safety program for the preparation and service of school meals served to children.

Food Distribution Program: Value of Donated Foods (July 1, 2010 - June 30, 2011)

This notice announces the national average value of donated foods or, where applicable, cash in lieu of donated foods, to be provided in school year 2011 (July 1, 2010 through June 30, 2011) for each lunch served by schools participating in the National School Lunch Program (NSLP), and for each lunch and supper served by institutions participating in the Child and Adult Care Food Program (CACFP).

This Notice announces the annual adjustments to the "national average payments,'' the amount of money the Federal Government provides States for lunches, afterschool snacks and breakfasts served to children participating in the National School Lunch and School Breakfast Programs; to the "maximum reimbursement rates,'' the maximum per lunch rate from Federal funds that a State can provide a school food authority for lunches served to children participating in the National School Lunch Program; and to the rate of reimbursement for a half-pint of milk served to non-needy children in a school or institution which participates in the Special Milk Program for Children.

Proposed Rule: Geographic Preference Option for the Procurement of Unprocessed Agricultural Products in Child Nutrition Programs

The purpose of this proposed rule is to incorporate this procurement option in the Programs' regulations and to define the term "unprocessed locally grown or locally raised agricultural products'' to ensure that both the intent of Congress in providing for such a procurement option is met and that any such definition will facilitate ease of implementation for institutions participating in the Child Nutrition Programs.

Categorical Eligibility: Temporary Assistance to Needy Families

This is a reminder of the statutory and regulatory requirements for categorical eligibility for the Child Nutrition Programs based on receipt of benefits from each state’s Temporary Assistance to Needy Families (TANF) program. Section 9(b) (12) of the Richard B. Russell National School Lunch Act restricts categorical eligibility to those TANF programs with standards that are comparable to or more restrictive than those in effect on June 1, 1995.

Direct Certification in the National School Lunch Program: State Progress in Implementation Report to Congress

This report responds to the legislative requirement of Public Law 110-246 to assess the effectiveness of State and local efforts to directly certify children for free school meals. Under direct certification, children are determined eligible for free school meals without the need for household applications by using data from other means-tested programs. The 2004 Child Nutrition and WIC Reauthorization Act required local educational agencies (LEAs) to establish a system of direct certification of children from households that receive Supplemental Nutrition Assistance Program (SNAP) benefits by School Year (SY) 2008-2009. In SY 2009-2010, 83 percent of LEAs directly certified participating SNAP students. These LEAs enroll 97 percent of all students in NSLP schools. States and LEAs directly certified 1.6 million more children at the start of SY 2009-2010 than they did a year earlier, a 24-percent increase. The percentage of SNAP participant children certified for free school meals without application increased slightly from 71 percent in SY 2008-2009 to 72 percent in SY 2009-2010.

Regional Office Review of Application (RORA) For School Meals 2008

This is the fourth in a series of annual reports that examines administrative error incurred during the local educational agency’s (LEA) approval process of applications for free and reduced-price meals in the National School Lunch Program (NSLP). In school year 2007/08 about 96 percent of students submitting applications for meal benefits received the correct level of meal benefits, based on information in the application files. The percent of all students with errors in the processing of their applications for meal benefits has remained relatively stable over the 4-year period, with administrative errors ranging between 3 and 4 percent.
