The purpose of this guidance is to clarify how to determine eligibility in SY 2023-24 for severe need reimbursement for breakfasts served through the School Breakfast Program and for the two cent differential reimbursement for lunches served through the National School Lunch Program. This guidance provides clarification to SP 11-2022, Determining Eligibility for Severe Need Reimbursement for the School Breakfast Program and the Two Cent Differential Reimbursement for the National School Lunch Program in School Years 2022-23 and 2023-24. 

This memorandum provides guidance to state agencies and school food authorities as they transition from COVID-19 nationwide waivers. This guidance applies to state agencies and school food authorities administering the NSLP and the SBP in SY 2022-23 and SY 2023-24.

Under this waiver, for all states, Summer Food Service Program and National School Lunch Program Seamless Summer Option closed enrolled sites during the COVID-19 public health emergency may determine site eligibility through area eligibility without collecting income eligibility applications.

This waiver extends until Dec. 31, 2020, the Nationwide Waiver to Extend Area Eligibility Waivers. 

FNS is cancelling Policy Memoranda FD-010, FD-027, FD-028, FD-029, FD-032, FD-053, FD-055, FD-071, FD-073, FD-074, FD-083, FD-086, FD-087, FD-090, FD-105, and FD-115. The guidance provided by these memoranda are either outdated, obsolete, or otherwise captured in more current memoranda.

FNS is issuing this memorandum in fulfillment of the commitment made in the preamble of the SNAP: Eligibility, Certification, and Employment and Training Provisions of the Food, Conservation, and Energy Act of 2008 final rule to provide additional guidance for state agencies on how to carry out the exclusion of certain military combat-related pay from income for purposes of SNAP eligibility determinations.

This memorandum details guidance on the annual Community Eligibility Provision notification and publication requirements and provides information on the USDA-developed reporting template.

This memorandum clarifies how to apply an exemption from the SNAP time limit for able-bodied adults without dependents related to individuals receiving U.S. Department of Veterans Affairs disability compensation. 

This memorandum addresses inquiries regarding flexibility in determining the effective date of eligibility for students who are directly certified to receive free meals or free milk in the National School Lunch Program, the School Breakfast Program, and the Special Milk Program.

Section 4 of the Richard B. Russell National School Lunch Act provides general cash for food assistance payments to states to assist schools in purchasing food. The NSLA provides two different section 4 payment levels for lunches served under the NSLP.
